The Lake Shore Community Association Newsletter, Aug 1999


banner At the annual meeting, I mentioned to everyone my concern regarding the delinquencies at the Lake Shore Community Association. One-fifth, or fifty people, is delinquent each and every month, on average. This is unacceptable and the Board of Directors is implementing a new policy regarding this serious problem.

I would like to take this opportunity to express thanks to those 200 who consistently pay their dues and hope that we can eliminate this problem completely. Your cooperation is greatly appreciated and please be prompt with your dues.

Your Association Dues

The timely collection of association dues is always an important part of an effective community association. As a reminder, your payment is due by the first of each month, and delinquent after the tenth. If you are paying after the tenth, add $10 to the monthly fee. If you have questions or anticipate that you will be unable to meet your financial obligation to the association, it is always better to contact CPMG's Finance Department in advance at 303-671-6402.

Electronic transfer allows your dues to be transferred directly from your bank to the Lake Shore's bank account. If you would like to sign up for this or need further information contact CPMG's Finance Department at 303-671-6402.

Fence Painting

Although repairs to the perimeter fence will be ongoing, the majority of the work has been completed and we are now ready to begin painting. The lake fence and the interior of the perimeter fence will be painted in the near future. Power washing is to begin on Tuesday, 7 Sep 1999.

If you live on the perimeter or around the lake and wish to have your backyard side fences painted at the same time, the painting contractor has agreed to do this for $200. You will need to make arrangements with Certa Pro Painters for this additional work. Their office phone number is 303-255-1365, or you can page them at 800-462-3782. Please keep in mind that, according to the association Declaration of Covenants, Conditions and Restrictions, Article VII, Section 2, Maintenance Easement:

An easement is hereby granted to the Association, its officers, agents, employees and assigns upon, across, over, in and under the Community Property and a right to make such use of the Community Property, as may be necessary of appropriate to perform the duties and functions which it is obligated or permitted to perform pursuant to this Declaration. Further an easement is hereby granted to the Association, its officers, agents, employees and assigns upon, across, over in and under the Fence Lots, as defined in Section 5 of this Article VII for performing maintenance on the Fence, as defined in Section 5 of Article VII. Such maintenance shall be performed during reasonable hours after reasonable notice to the Owners or Occupants of any affected Fence Lot, except that in emergency situations entry upon a Fence Lot may be made at any time, provided that the Owners or occupants of any affected Fence Lot shall be warned of the impending emergency entry as early as is reasonably possible.

What does this mean? Very simply, it means the painting contractor will be coming into your backyard to paint the fence.

In addition, Article VII, Section 5, Fence Easement, states:

A three-foot (3') wide perpetual easement ("Fence Easement") is hereby granted to the Association for the installation, maintenance, repair, replacement and continued existence of a perimeter fence ("Fence") measured from and along (i) the rear lot line of Lots 1 through 43 inclusive, Block 14; Lots 1 through 32, 34 through 36 and 42 through 46, inclusive, Block 2; Lots 1 through 11 inclusive, Block 1; Lots 13 through 23 inclusive, Block 7 of the Country Lane Subdivision Filing No. 2 ("Filing No. 2") according to the Plat thereof recorded in the Arapahoe County, Colorado Records and Lots 1 through 6 and 8 through 18 inclusive, Block 1 of the Country Lane Subdivision Filing No. 3 according to the Plat thereof recorded in the Arapahoe County, Colorado records; and (ii) the south side lot line of Lot 11, Block 14 of Filing No. 2; and (iii) the north side lot line of Lot 12, Block 14 of Filing No. 2 (collectively the "Fence Lots").

And what does this mean? It means that nothing should be permanently affixed or growing in the three-foot easement except grass or annuals. Any such items encroaching on this easement run the risk of being damaged or destroyed during any fence repair.

Please remove any items from this easement prior to 7 Sep 1999 and keep this easement clear for any future work.

Thank you to all the Lake Shore homeowners who keep their dogs on a leash around the lake and pick up after them. We appreciate your adherence to the community rules. Please remember all dogs must be on a leash (with you on the other end) and you are responsible for picking up what your dog leaves behind. It is so easy to carry a plastic bag for that chore!

Also, when walking your dog, please do not allow it to run along the fence with any dog in its own yard. This can upset the confined dog and creates excessive barking that the homeowners of neighboring homes do not appreciate.

Fishing Policy

As a reminder to all the fishermen and women in the community, Lake Shore has a "catch and release" policy. You must use barbless hooks to prevent injury to the fish. The fish are an important part of the lake's ecosystem and need to be returned to the lake in order to maintain the correct ecological balance. Restocking the lake costs approximately $6K annually.

Board of Directors meetings are on the second Wednesday of each month at 7:00 PM at the CPMG office. All Lake Shore homeowners are welcome to attend.

Trash Service Reminders

Lake Shore Community's trash collection day is Monday. If a holiday falls on that day, service will be one day later. Please remember the following:
  • All trash should be at the curb by 7:00 AM. By city ordinance, you may place your containers at the curb after 5:00 PM the night before and you must remove them within 12 hours after pickup.
  • Tied plastic bags or 32-gallon garbage cans may be used. Please do not over fill them.
  • Do not use cardboard boxes or paper sacks as trash receptacles as the bottoms tend to fall out when they become damp.
  • Tree limbs must be cut into four to five-foot lengths and bundled.
  • Boxes must be broken down and bundled.
  • Yard waste should be placed in disposable bags no heavier than forty pounds (limit of ten bags per week).
  • Recycling is also available. Contact Waste Management of Colorado at 303-797-1600 for service.
