The Lake Shore Community Association Rules and Regulations
Effective 1 Jun 2003
The association has adopted and established these rules and regulations to help maintain the community as a prime residential place to live and a place to be proud to live in. Any violation of the following rules and regulations will result in action being taken as set forth in the enforcement section.
Operations
Swimming Pool
Violation of the rules posted at the pool may result in the enforcement as listed herein and may also result in the withdrawal of the individual's pool pass.
- Only owners, residents, and their guests, which shall be limited to eight, may use the swimming pool. An adult resident must accompany all guests.
- Lifeguards and Pool Committee members enforcing pool rules shall be treated with respect.
- All signs and rules posted in the pool area must be followed at all times.
- No inappropriate behavior shall be permitted.
- Proper swimming attire is required at all times. No cut-offs and/or shorts are allowed.
- Pets are not permitted in the pool area at any time.
- No glass containers are allowed in the pool area. No food or drink may be served or consumed within three feet of the pool.
- No pool furniture may be removed from the pool area at any time.
- No offensive noise or language shall be permitted.
- Everyone entering the pool area shall have a pool pass and shall sign in and out.
- Smoking is permitted in designated areas only.
- The pool shall only be used during specifically scheduled times.
Lake
- Nothing shall be thrown in the lake nor shall trash be discarded in the lake area unless placed in the appropriate containers.
- The lake area is for use only by owners, residents, and their guests.
- No one shall enter the water or walk on the perimeter rocks.
- No dogs shall enter the water.
- There shall be no disturbance to any plant material in the lake area.
- No inappropriate behavior shall be permitted.
Gazebo
- The gazebo is for use only by owners, residents, and their guests.
- An owner must be present during the use of the gazebo.
- All trash shall be removed after use.
- No inappropriate behavior shall be permitted.
Emergency Pager
- After hour emergency pagers (utilized by maintenance personnel and management personnel) shall only be called for emergencies. An emergency is imminent loss of life or property.
- After hour pages, which are not emergencies or concern an issue that is not the association's responsibility shall, not only be a violation of these rules and regulations, but also the owner who paged shall be invoiced accordingly.
Rules Enforcement
These rules and regulations are enforceable by the association.
- Complaints against violators of any violations of the rules and regulations shall be submitted to the association in writing stating the nature of the violation, date, time, location, name(s) of the accused, and all pertinent facts needed to support the complaint(s). For intangible violations (noise, etc.), two written complaints from two different owners must be received before action will be taken.
- If a violation of any rule or regulation occurs, the appropriate owner shall be sent a first offense notice requesting correction of the infraction or immediate cessation of the action, unless otherwise stated. If the problem continues or another violation occurs, a second offense notification shall be sent and, if requested by the notified owner, a hearing shall be scheduled by the Board of Directors. After the hearing, the board will decide if a fine should be allocated. If a hearing is not requested or the notified party does not attend, a fine will automatically be assessed. Subsequent violations shall warrant the sending of third, fourth, and continued offense notifications, which shall include notice of the respective fine. Any out-of-pocket expenses incurred by the association shall be passed on appropriately.
- First Offense: Warning letter
- Second Offense: Attend a hearing and/or a $50 fine
- Third Offense: $100 fine
- Fourth Offense: $200 fine
- Continued Offense: Up to $100 per day
- Any owner who receives a violation notice may attend a regularly scheduled board meeting to discuss the violation with the board. If an owner wants the violation issue to be placed on the meeting's agenda for discussion, the owner needs to notify the property manager at least ten days prior to the date of the meeting.
- If the offense is a city code, ordinance, or statutory violation, the proper authority should be notified.
All fines charges and fees assessed under these rules and regulations shall be treated the same as an assessment. Any penalty assessed against an owner that remains unpaid for thirty days shall be treated as an assessment to the lot.
